( he knows midnighter could have, easily, known exactly what jason was going for and stopped it. or at least, jason's assuming so. super computer fight brain, blah blah blah, and jason wasn't working to be particularly stealthy about his next move. mostly because he wasn't going to make it until he did, and he didn't stop to consider that midnighter is--well himself.
and isn't behind the bar when jason's moving to try and right himself back up now that he'd essentially flipped midnighter over himself. he's given a split second to recognize the missing body in the mess before there's a boot coming at him, and he's rolling across the bar to try and get away from it. if they weren't mid-fight, he'd recognize that this is a real bad move: he's not geared up, his face is visible, they're in a bar that's known as junior's with his siblings as known employees, and midnighter's not bothering to hide his abilities. too late for regrets now.
